Protecting Your Record From Drunk Driving Charges

Drunk driving charges are officially referred to as operating under the influence (OUI) in Massachusetts. You can be charged with OUI if you are found driving with a blood alcohol content (BAC) of 0.08 or above. Minors under the age of 21 can be convicted with a BAC as low as 0.02. The number of drinks that it takes to reach this level of intoxication can drastically differ from person to person. While difficult to predict, the consequences of OUI charges are severe. If you are charged with OUI, you should contact a Boston OUI defense lawyer to protect your license, finances and record.

Understanding The Consequences Of A Conviction

In 2005, Massachusetts passed what is known as “Melanie’s Law” which increased the severity of potential OUI penalties. Even a first-time offender may face up to 30 months in jail, $2,000 in fines and a suspended license for a year. By a fifth offense, an individual could face five years in jail, $50,000 in fines and permanent license revocation.

Penalties also increase if you are driving with a child under the age of 14 in your vehicle at the time of arrest. In addition to OUI charges, you would also be charged with child endangerment. If convicted, you would spend between 90 days to two-and-a-half years in jail and face fines between $1,000 and $5,000.
