Attorney Carney Recently Secured A Favorable Outcome In A Child Pornography Case In Federal Court
A federal jury of 10 men and two women returned a verdict of not guilty this morning on three counts of production of child pornography and attempted production of child pornography in the case of Josh Wairi, the Graham & Parks school teacher arrested in April 2014.
Attorney Carney Recently Secured An Outright Dismissal For A Client Charged With First Degree Murder.
He was able to achieve this successful outcome by presenting compelling evidence to the state medical examiner that directly undermined the prosecution’s claim that the victim’s death had been the result of “Shaken Baby Disorder/Abusive Head Trauma.” Attorney Carney and his team uncovered a wealth of evidence indicating that the victim suffered from certain genetic conditions that ultimately caused his tragic death. After considering this evidence, the medical examiner was persuaded to amend the death certificate to reflect that he had changed his finding as to the victim’s manner of death from “homicide” to “undetermined.” Attorney Carney was later able to convince the District Attorney’s Office to drop the charges against the client, an unprecedented result in a first degree murder prosecution.
Attorney Carney Obtained Another Successful Result In A Well-Publicized Case In The Newburyport District Court.

The client was initially charged with a mandatory minimum sentence of 10 years and faced even more prison time if convicted at trial. Attorney Carney successfully convinced the prosecution to reduce the charge against the client so that the client would not be subject to a mandatory minimum sentence.
Attorney Carney was able to reach a favorable result for another client on a drug case in state district court.
The client was originally facing a mandatory minimum sentence based on a so-called “school zone” drug violation. That charge was eventually dismissed. Attorney Carney prepared a lengthy sentencing memo with which he was able to persuade the judge to grant the client a continuation without a finding, meaning that the client received probation without the entry of a criminal conviction.
