Tips for avoiding an OUI after a tailgate

Law Office of Carney, Gaudet & Carney

Before you go tailgating around Massachusetts, you need to be cognizant of what the law says. You deserve to have a fun tailgate party without running afoul of the law.

Even after the game is over and Boston University has won another game, you need to be careful about how you get home. You do not want to end up with operating under the influence charges, so be careful about how you party at the game.

Have a designated driver

Before you leave for the game, you should decide amongst your group who will drive home. The best course of action any group of friends can take is to have one person who abstains from alcohol the entire evening. This person should not even have one beer, just in case. Everyone else in the party can make it easier for this person by chipping in for a gift or offering to buy him or her food for the event.

Conduct a vehicle check

Before heading out to the game, you want to make sure everything in your car works as it should. Check the lights and brakes, so you do not end up making any crazy maneuvers while on the road. The police will use any sign they can find to pull you over, and even if you are sober, the cops will put you through the wringer to see if you are under the influence.

Clear all alcohol cans

You do not want there to be any beer cans or bottles, even if they are empty, inside your vehicle. This is a telltale sign that you drank earlier, and it can be particularly detrimental if you have underage passengers in your vehicle. You should never travel with empty cans or bottles of alcohol. Always dump them off in the nearest recycling receptacle before you get back on the road.
