Massachusetts Laws And Penalties For Prostitution Charges, Solicitation And Human Trafficking

Prostitution Charges

The legal definition of prostitution, according to Massachusetts General Laws Chapter 272, Section 53A, is engaging in sexual conduct for a fee. Prostitution is a crime in the state of Massachusetts. Sexual conduct does not have to have occurred for someone get prostitution charges. It is enough in the eyes of the law to discuss engaging in sexual conduct and accepting a fee.

The penalties for those convicted include up to a year in a correctional facility, up to a $500 fine or both. A DNA sample is required for conviction.

Solicitation

It is also a crime to solicit a prostitute in Massachusetts. The definition of solicitation according to Massachusetts General Laws Chapter 272, Section 8, is seeking the services of a prostitute or paying for sexual services. Accepting payment for either of those things is also considered solicitation.

The penalties for solicitation include up to 2 1/2 years in a correctional facility, fines ranging from $1,000 to $5,000 or both.

Human Trafficking

According to Massachusetts General Laws Chapter 265, Section 50, human trafficking is transporting or coercing people to benefit from their work or service. Human trafficking typically takes the form of forced labor or sexual exploitation.

There is a minimum mandatory five-year state prison sentence for anyone convicted of human trafficking in Massachusetts. That sentence cannot be suspended; it must be served. The statute provides a maximum prison sentence of 20 years. A $25,000 fine may also be imposed.

Human trafficking is often charged as a federal crime, which carries even harsher consequences and longer prison sentences.
